Conditions
Quik Internet of Boston
reserves the right to refuse service to any person for inappropriate
behavior. Our Customers agree to follow these policies regarding Internet
use. Currently these policies prohibit but are not limited to:
- Any use which violates
any applicable local, state, or federal law of the United States of
America, including but not limited to copyright, trade secret, or
criminal laws.
- System abuse is strictly
prohibited. Quik Internet of Boston may terminate or modify service
immediately and may bill for any resulting support charges if the client
engages in system abuse. Following is a list of actions which are
defined to be system abuse. This list is non-exclusive; any action about
which there is any doubt should be referred to Quik Internet of Boston
for evaluation.
Actions which constitute system abuse include, but arenot limited to:
- attempting to
circumvent user authentication or security of any host, network, or
account on Quik Internet of Boston systems or the Internet at large
("cracking");
- attempting, in any
way, to interfere with or deny service to any user or any host on the
Internet; forging email or USENET posting header information;
- sending large
numbers of unsolicited mail messages (i.e. "junk mail"); this
includes adding or attempting to add addresses to any mailing list
without explicit positive consent of the addressee.
- forwarding or
posting "chain letters" (multiple forwarding) of any type;
- posting
inappropriate messages to USENET newsgroups e.g., posting large numbers
of unsolicited posts indiscriminately ("spamming"), or
posting encoded binary files to USENET newsgroups not specifically
named for that purpose;
- attempting to
cancel, supersede, or otherwise interfere with email or USENET posts
other than one's own;
- engaging in
harassment, whether through language, frequency, or size of messages;
using an account at another provider to promote a Quik Internet of
Boston Web site in an abusive manner;
- using a Quik
Internet of Boston account or network connection to collect replies to
messages sent from another provider which violate these rules or those
of that provider; reselling Quik Internet of Boston services to third
parties who do not abide by these guidelines.
- Any use to make
unauthorized entry to other computers, computer information, or
communication devices or resources.
- Uploading files
without the consent of the copyright or patent owner.
Should any action by any Customer in violation of these limitations or
policies result in a disruption or interference with Quik Internet of Boston
or Quik International's network operation, the Customer will be disconnected
from further service without notice.

Local Access
Numbers and Incurred Charges
Quik Internet is not responsible for long distance toll charges incurred
while accessing the internet. Before using any access numbers, please dial
"0" and ask the operator if the number is local to your dialing
area. A complete list of our access numbers covering the Massachusetts area

Currently these policies
require but are not limited to:
- Payment in advance is
required for all plans and is due by the anniversary of their signup
date for the next period of service. All sales are in monthly
increments. Monthly, semiannual, and annual payment plans are available.
Accounts are never pro-rated. Refunds are never allowed.
- Accounts choosing
billing method must send in the first month's payment to the local Quik
office at PO Box 406, Accord, MA 02018 so that it is received within
seven (7) days of activation to maintain the account in good standing.
- Accounts choosing
direct withdrawal from their bank authorize Quik to apply advance
billing (next month billing) to their accounts and commit to maintaining
a balance sufficient to cover all withdrawals.
- All accounts that are
30 days late on their payments will be put on hold (denied access) until
full payment is received. In the case of returned checks Quik reserves
the right to wait until the new check clears the customers bank before
restoring service.
- All accounts that are
45 days late on their payments will be deleted from the Quik server and
the records sent to collection and credit agencies.
- If a payment for any
monthly, semiannual, or annual plan is 30 days or more past due, the
payment will be applied to all outstanding balances and late fees first.
The standard monthly rate in effect will be applied on all late payments
first, then the late fees. Any remaining balance will be applied towards
the next month's payment at the standard monthly rate.
- FEES SCHEDULE:
A $10.00 fee will be assessed all accounts 14 days past due on their
accounts.
A $20.00 fee will be assessed for returned checks.
A $10.00 fee will be assessed for declined credit card payments.
A $50.00 fee will be assessed on all accounts sent to collection.
- Quik Internet of
Boston may change any fee, rate, or package upon seven (7) days notice.
- In the case of domain
name hosting Quik Internet of Boston reserves the right to withhold
transfer of the domain to another ISP if the accumulated fees for that
site have not been paid in full. Additionally, if fees are outstanding
more than 30 days Quik Internet of Boston reserves the right to disable
that site and display on that site the reason for disablement as non
payment of hosting fees.
- Quik Internet of
Boston and Quik International have every intention to keep all aspects
of Customer accounts private, but it is impossible for Quik Internet of
Boston and Quik International to guarantee that any activity done while
using its service will be completely private. Customers can increase
their level of privacy by using data encryption. Privacy is not
guaranteed. Customers are responsible for their Internet accounts. Ask
us to change your password often to enhance security and prevent unauthorized
use of your account.
- Customers under 18
years of age may not apply for this service without parental approval.
- Customers specifically
agree to defend, indemnify, and hold harmless Quik Internet of Boston
and Quik International, it's agents, officers, directors, employees,
successors, and assignees, from any claim, loss, or damage, including
costs and attorney fees, arising out of or related to any act of
omission of the Customer under this agreement, including without
limitation the Customers causation of such damages or injury, directly
or indirectly, to any party.

Cancellation
Procedures
Customers wishing to cancel accounts must email, fax or write the local Quik
Internet office of that intention. There is no other reliable way to cancel a
Quik account.
- The local Boston Quik
office mailing address is PO Box 406, Accord, MA 02018.
- Email must be sent to
stop@quik.com.
- The fax number is (309)
401-1375.
- The customer is
encouraged to keep a copy of their cancellation letter or email.
- Customers
cancellations via telephone are NOT accepted
- Customers attempting
to cancel by returning their billing notice to our billing department
with cancel written on it should be aware that this process is very
unreliable and does not constitute proof of cancellation. The customer
must email or write the local Quik office.
- Monthly accounts
automatically renew and charges are automatically due for the next month
unless the Quik Internet local office is notified by email or letter of
customer's intent to cancel.
- The entire month's
service is purchased no matter when during the month the customer
cancels.
Upon cancellation of an account by a customer, all unpaid
charges are immediately due and payable. An account that is deleted from our
system with current charges unpaid is immediately sent to collection. It is
the customer's responsibility to avoid the collection process by paying,
immediately upon cancellation, all unpaid charges incurred, including all
late fees, returned check charges and credit card decline fees. Charges will
continue to accrue until all unpaid fees are paid or account is sent to
collection.

Reasons for denying a customer
access to their account (account is on hold) and/or disabling their domain
hosting site include but are not limited to: (hosting sites disabled for non
payment of hosting fees will have a sign to that effect displayed on their
site until fees are paid)
- Method of payment is
billing and no payment has been received 14 days after the due date.
- Account is a new sign
up on billing method of payment and no payment has been received at the
local Quik office by the seventh day after activation.
- Method of payment is
credit or debit card and card is declined, rejected or bad account
number.
- Method of payment is
automatic withdrawal from bank and check is returned for insufficient funds
or closed account.
- Method of payment is
billing and check is returned NSF (insufficient funds) or account
closed.
- Account has been
implicated in spamming or other illegal activities.
- Customer representing
account has demonstrated obnoxious or abusive behavior towards other
Internet customers, Quik employees or services hired by Quik.

Troubleshooting
limitations:
When a customer calls Quik offices for help with their computer configuration
it is assumed by Quik personnel:
- The customer assumes
all liability for the outcome.
- All software and
hardware involved is owned by and is the responsibility of the customer.
- Quik employees will
try and help the customer but they are not experts in all
software/hardware combinations and are merely helping at the sole
request of the customer.
- Software distributed
by Quik is a Microsoft product and merely carries the Quik brand.
- Quik takes extreme
precautions to ensure the quality of any software distributed on
writable media (diskettes. writable CD ROM, etc) including virus
scanning using McAfee Virus Scan with the latest DAT files. However,
once software on writable media leaves Quik offices Quik no longer has
control of that software and the customer assumes full responsibility
for Quality Control, including virus scanning, prior to using the
software.
- Quik neither produces
nor sells software and assumes no responsibility for the accurate
working of any third party software.
- Quik sells only
connectivity to the Internet and web site hosting. The correct concern
of troubleshooting by Quik employees is limited to connection of the
customer to the Internet and web site hosting.

Virus Control Policy
We scan all of our local machines 100% of the time when uploading or
modifying any webserver or related files. No machine that is in contact with
our servers with administrative capability goes unscanned.
We also educate, inform and alert all franchise owners who then educate,
inform and alert their customers about basic virus protection and any new
viruses which may appear on the internet or otherwise, with instructions on
how to find more information and any possible procedures to remove viruses
from machines that are already infected.
This information is easy to find and available on our Frequently Asked
Questions web site, under the 'Advisories/Alerts' section. We also provide
links to the largest virus-information databases and anti-virus software.

Agreement conditions:
- This agreement shall
be controlled by the laws of the Commonwealth of Massachusetts,
Massachusetts courts shall have jurisdiction over this agreement, and
all litigation hereunder shall, be tried in the state of Massachusetts.
- The Customer shall
provide all equipment and telephone services necessary for modem access
to the service. Quik Internet of Boston and Quik International shall not
have responsibility for any charges or tariffs related to any Customer
telephone connection or on-line service of any entity accessed by or for
the Customer.
- This agreement shall
continue from billing period to billing period until terminated as
provided herein.
- Quik Internet of
Boston may suspend service at any time, for any or no reason, upon
notice. No notice shall be required in the event of non-payment or
violation of these provisions.
- Customers may
terminate this agreement upon notification of Quik Internet of Boston.
Termination will only be at the Customers request if the Customer is not
under the age of 18. Legal Guardians of Customers under the age of 18
may terminate the account of Customers under 18. Notification can be made
by email, mail, or fax to the local Quik Internet of Boston office only.
Accounts cannot be cancelled in any other manner.
- All amounts, including
late fees, credit (debit) card fees, check return fees and collection
fees, of accounts terminated for non payment or illegal activity will be
sent to a collection agency for collection and to credit history firms
for recording as bad debt. In the event that any account is sent to a
collection agency, the Customer is liable for all collection fees and
all legal fees.
- The Customer
understands and agrees that the Internet is a conglomeration of on-line
data bases operated by distinct entities having no business or legal
relationship to Quik Internet of Boston or Quik International. Quik
Internet of Boston and Quik International do not have input whatsoever
as to the content of Internet data accessed via the service. Customers
are solely responsible for any value or reliance it places on
information obtained via the Internet or this service. Information
derived as a result of this agreement is provided "AS IS" and
at the Customers own risk.
- The only warranty from
Quik Internet of Boston and Quik International, which is subject to the
terms and conditions of this agreement, is to provide Customers with
access to the Internet, email, and Internet website hosting. Quik
Internet of Boston and Quik International make no other warranties,
either express or implied.
- The Customer
specifically agrees that, in no event, shall any liability accrue to
Quik Internet of Boston and Quik International as a result of this
agreement in excess of the Customer's monthly fee of any single month
during which any claim of liability arose. The Customer agrees that the
American Arbitration Association will mediate all claims of liability.
- Upon request Quik
Internet of Boston and Quik International will provide software for
basic Internet access. Quik Internet of Boston and Quik International
can make suggestions about other useful software to use with a Customers
Internet service. Other companies develop the software. Quik Internet of
Boston and Quik International may not be held liable for the use of any
such software. All such use is at the discretion of the Customer and is
without warranty, either express or implied by Quik Internet of Boston
and Quik International.
